1. Scope

This shipping policy applies to all orders placed via the online shop www.golfballs.at by consumers and businesses (within the meaning of § 1 KSchG) with Golfsport Company Trading GmbH (hereinafter referred to as "we" or "Seller"). Our General Terms and Conditions (GTC) shall also apply.

2. Delivery Area

We deliver to delivery addresses in the following countries:

  • Austria (standard shipping)
  • Germany
  • EU Member States (upon request or depending on product availability)

Deliveries to non-EU countries, parcel lockers, post office boxes or poste restante are currently not possible. Any delivery restrictions for certain countries or products will be displayed at the latest at the start of the ordering process (§ 8 FAGG).

3. Shipping Costs

All prices stated include statutory value-added tax (20 % VAT). The shipping costs will be displayed to the customer before completion of the order in full and transparently (§ 4 Abs. 1 Z 4 FAGG). If the Seller fails to comply with this information obligation, the consumer shall not bear these costs (§ 4 Abs. 5 FAGG).

Note: Different shipping costs may apply to particularly heavy or bulky items (e.g. golf simulator systems, bulk golf bag orders). These will be stated separately in the respective product listing and at the latest during checkout.

4. Shipping Service Providers

Shipping is carried out via the following logistics partners:

  • GLS Austria / GLS Germany
  • DHL
  • UPS (for selected products and bulky goods)

The choice of shipping service provider is at the Seller's discretion and depends on parcel size, weight and destination country. The customer is not entitled to a specific shipping service provider unless expressly agreed otherwise.

5. Delivery Times

The estimated delivery times are:

The delivery period begins after receipt of payment (for advance payment/bank transfer) or after order confirmation (for immediate payment methods such as credit card, PayPal, Klarna). Should an item not be in stock, we will inform the customer without delay and state the estimated delivery time. If the stated delivery time is exceeded, the consumer has the right to withdraw after an appropriate grace period has expired without result (§ 7a KSchG).

The Seller shall not be liable for delivery delays caused by force majeure, strikes, natural disasters or other unforeseeable circumstances.

6. Shipment Tracking

After shipping, you will receive a shipping confirmation by email with a shipment tracking number (tracking number). You can use this to track the current status of your delivery at any time on the website of the respective shipping service provider.

7. Transfer of Risk

For consumers, the risk of accidental loss and accidental deterioration of the goods shall only pass to the consumer upon handover of the goods to the consumer or to a person authorised to receive them designated by the consumer (§ 7b KSchG). This does not apply if the consumer has commissioned a carrier not offered by the Seller.

For businesses (B2B), the risk passes upon handover to the carrier.

8. Damaged Delivery / Transport Damage

Should a delivery be visibly damaged upon delivery, we ask you to:

  • Report the damage to the delivery driver upon acceptance and, if possible, note it on the delivery receipt.
  • Document the damage with photos (packaging and goods).
  • Contact us without delay at shop@golfballs.at.

Reporting transport damage does not affect the consumer's statutory warranty rights and is not a prerequisite for asserting them.

9. Undeliverable Shipments

If a parcel cannot be delivered due to an incorrect address or unsuccessful delivery attempts and is returned to us, the customer shall bear the costs of return shipping as well as the costs of reshipping, provided they are at fault (e.g. incorrect address details). We will inform the customer of the costs incurred before reshipping.

10. Partial Deliveries

We reserve the right to make partial deliveries, provided this is reasonable for the customer. Partial deliveries do not incur any additional shipping costs for the customer, unless the partial delivery is made at the express request of the customer.

11. Right of Withdrawal (Cancellation Right)

Consumers have the right, pursuant to §§ 11 ff. FAGG, to withdraw from the purchase contract within 14 calendar days without giving any reason. The withdrawal period begins on the day on which the consumer or a third party designated by them (who is not the carrier) has taken possession of the goods.

12. Return / Return Shipment

In the event of a lawful withdrawal, the consumer must return or hand over the goods to us without delay and no later than within 14 days after submitting the withdrawal declaration (§ 13 FAGG).

The consumer bears the direct costs of returning the goods, unless expressly agreed otherwise or the seller has failed to inform the consumer thereof (§ 13 Abs. 3 FAGG).

We will reimburse all payments made by the consumer, including delivery costs (with the exception of additional costs resulting from the consumer choosing a delivery method other than the least expensive standard delivery offered), without delay and no later than within 14 days of receipt of the withdrawal declaration. The reimbursement will be made using the same means of payment that the consumer used for the original transaction, unless expressly agreed otherwise (§ 14 FAGG). We may refuse reimbursement until we have received the goods back or the consumer has provided proof that they have returned the goods.

13. Warranty

The statutory warranty provisions pursuant to §§ 922 ff. ABGB in conjunction with the Consumer Warranty Act (VGG) apply. The warranty period is 2 years from delivery of the goods to the consumer. Within the first 12 months, it is presumed that a defect already existed at the time of delivery (reversal of the burden of proof pursuant to § 924 ABGB).

14. Payment Methods

The following payment methods are accepted:

  • Credit card (Visa, Mastercard)
  • PayPal
  • Klarna (invoice, instalment purchase)
  • Bank transfer / advance payment
  • Shopify Payments

The accepted payment methods are displayed no later than at the beginning of the ordering process in accordance with § 8 Abs. 2 FAGG. No additional fees are charged to the customer for using the payment methods offered.

15. Collection in Person

Upon request and by prior arrangement, orders can also be collected at our location in 2482 Münchendorf. Collection is free of charge. Please contact us in advance by email at shop@golfballs.at to arrange an appointment.

17. Applicable Law & Place of Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the meaning of the KSchG, the mandatory provisions of the law of the state in which the consumer has their habitual residence apply, provided that these offer more extensive protection (Art. 6 Abs. 2 Rome I Regulation). The place of jurisdiction for claims against consumers is determined by the statutory provisions (§ 14 KSchG); for entrepreneurs, the seller's registered office is the place of jurisdiction.
